Terms of Service

1. Acceptance of Terms

By accessing or using CreatorBot ("the Service"), operated by NatureBased, LLC ("we," "us," or "the Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. Your continued use of the Service constitutes your acceptance of these Terms and any future modifications.

2. Description of Service

CreatorBot provides AI-generated analysis and audit reports for TikTok accounts. The Service uses artificial intelligence, automated data collection, and algorithmic analysis to generate recommendations and insights about social media content. All reports, scores, recommendations, video ideas, and other outputs are generated by artificial intelligence and are provided for informational and entertainment purposes only. They do not constitute professional, financial, legal, marketing, or business advice.

3. No Guarantees

We make no guarantees, representations, or warranties of any kind regarding the accuracy, completeness, reliability, or usefulness of any information, analysis, recommendation, or content provided by the Service. AI-generated content may contain errors, inaccuracies, or outdated information. Any actions you take based on the Service's output are taken entirely at your own risk. We do not guarantee any specific results, including but not limited to increases in followers, views, engagement, revenue, or any other metric.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NATUREBASED, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, REVENUE, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service;
  • Any conduct or content of any third party on the Service;
  • Any content, recommendations, or analysis obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or content;
  • Any actions taken or not taken based on the Service's output;
  • Any impact on your social media accounts, including but not limited to changes in follower count, engagement rates, content performance, or account standing;
  • Any errors, inaccuracies, or omissions in the AI-generated analysis;
  • Service interruptions, delays, or failures;
  • Any other matter relating to the Service.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF NATUREBASED, LLC FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO NATUREBASED, LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS LESS.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. NATUREBASED, LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

6. Indemnification

You agree to defend, indemnify, and hold harmless NatureBased, LLC, its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from or related to:

  • Your use of or access to the Service;
  • Your violation of these Terms;
  • Your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right;
  • Any claim that your use of the Service caused damage to a third party;
  • Your TikTok account activity or content;
  • Any actions you take based on the Service's recommendations or analysis.

This indemnification obligation will survive the termination of these Terms and your use of the Service.

7. Third-Party Data and Services

The Service collects and analyzes publicly available data from TikTok and other third-party platforms. NatureBased, LLC is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance, or any other social media platform. We do not guarantee the accuracy, completeness, or timeliness of any data collected from third-party sources. The availability of third-party data may change without notice, which may affect the Service's functionality.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by NatureBased, LLC and is protected by copyright, trademark, and other intellectual property laws. Audit reports generated for you are licensed to you for your personal or business use. You may not resell, redistribute, or publicly publish the reports without prior written consent. NatureBased, LLC retains all rights to the AI models, algorithms, and underlying technology used to generate reports.

9. User Accounts and Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unauthorized purposes.

10. Payment and Refunds

All payments are processed through Stripe. Prices are displayed before purchase and are based on account size and selected audit tier. All sales are final. Due to the computational costs incurred in generating each audit report, refunds are generally not provided. In exceptional circumstances, refund requests may be reviewed on a case-by-case basis at our sole discretion.

11. Privacy

We collect and process personal information necessary to provide the Service, including your email address, payment information (processed by Stripe), and TikTok account data that is publicly available. We do not sell your personal information to third parties. Data collected for audit analysis is stored securely and used solely for the purpose of generating your reports. By using the Service, you consent to this data collection and processing.

12. Assumption of Risk

You expressly acknowledge and agree that your use of the Service is at your sole risk. You assume full responsibility for any consequences arising from implementing any recommendations, strategies, or suggestions provided by the Service. Social media performance is inherently unpredictable and subject to numerous factors beyond the control of NatureBased, LLC or its AI systems.

13. Modifications to Terms

NatureBased, LLC reserves the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes to the Terms constitutes acceptance of those changes.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit against NatureBased, LLC.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
